These Terms of Service ("Terms") govern your use of the Rapidly website at rapidly.io. By using the website you agree to these Terms.

What these Terms cover

These Terms cover your use of the website only. They do not cover:

Use of the Rapidly SDK. The SDK is licensed under a separate Rapidly Licensing Agreement provided when you obtain a license key. That agreement governs how you may install, integrate, distribute, and use the SDK, and it takes precedence over these Terms for everything related to the SDK.
Personal data. How we handle personal data on the website is described in our Privacy Policy.

All content on rapidly.io is owned by Rapidly Labs AS or our licensors. This includes the text, layout, code, and design of the site; the demo media we provide (audio, video, or other formats) and the output produced when that media is processed by our technology in your browser; and our marketing assets and product names.

You may view the website and share links to it. You may not copy, redistribute, mirror, or republish substantial portions of the content without our prior written permission. Personal, non-commercial sharing of links is welcome.

Third-party links and services

The website may link to third-party services, such as our public GitHub repository or our social profiles. We do not control those services, and we are not responsible for their content or how they handle your data. Use them at your own discretion.

"As is" and no warranties

The website is provided "as is" and "as available". To the maximum extent permitted by law, Rapidly Labs AS disclaims all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the maximum extent permitted by law, Rapidly Labs AS and its directors, employees, contractors, suppliers, and licensors will not be liable for:

any indirect, special, incidental, consequential, or punitive damages;
loss of profits, revenue, data, goodwill, or business opportunity;
the cost of substitute products or services;
any matter beyond our reasonable control.

This applies whether the claim is brought in contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Norwegian law.

Indemnity

You agree to indemnify and hold harmless Rapidly Labs AS and its directors, employees, contractors, and licensors against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your use of the website in breach of these Terms or in violation of applicable law.

Children

Our website is not directed at children under 16, and we do not knowingly permit anyone under 16 to use it. If you are under 16, please do not use the website.

Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with an effective date at the bottom. Material changes will be flagged at the top of this page. Your continued use of the website after a change takes effect constitutes acceptance of the new Terms.

Governing law and disputes

These Terms are governed by the laws of the Kingdom of Norway, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms or your use of the website will be subject to the exclusive jurisdiction of the Oslo District Court (Oslo tingrett).

General

These Terms, together with our Privacy Policy and any separate agreements we sign with you (such as the Rapidly Licensing Agreement), constitute the entire agreement between you and Rapidly Labs AS concerning the website. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
